The New 1776 Political Experiment, What It Is, and Why the US Supreme Court Doesn't Understand It
The phrase "New 1776 Political Experiment" was created by me to help people unde
rstand the actions that the American colonists had taken in 1776 to separate the American colony from Great Britain. This separation required war. Thus, the Revolutionary War had to be initiated and was authorized by the colonists with the Declaration of Independence.
However, the Declaration of Independence had another purpose. Unfortunately, US lawyers and judges at the US Supreme Court do not seem to understand this other purpose. The other purpose had to define the political system that could develop a perfect form of ' freedom' for its citizens. Long before 1776, England's John Locke had distinguished man's social freedom from man's natural freedom. Of these two forms of freedom, man's natural freedom is greatest but offers no protection of life. On the other hand, social freedom is reduced but provides it people protection with laws and law enforcement. Today, different nations provide different degrees of social freedom for their citizens.
To prevent the ruling by dictators, monarchies, or oligarchies, the American colonists decided to replace the old dualism, ruled/ruler, with Locke's the new dualism, governed/governing. The new dualism is a 'self-governing' system in which the people of a nation self-governs. Locke's new dualism originates in the development of social contract theory. His social contract theory requires two contracts. The first agreement is between 'all of the people' of a nation. This agreement creates 'society' (or the governed) and is defined in the Declaration of Independence. The second agreement creates 'government' (or the governing) and is defined by the Constitution.
The US Supreme Court is making major mistakes because it does not seem to understand the New 1776 Political Experiment. For instance, the Court does not understand that the the first paragraph, the second paragraph, and the last sentence in the Declaration of Independence defines the first agreement among 'all of the people.' Since the colonists created a society under God, the mistakes of the Court have confused the people unnecessarily. People must accept the natural fact that 'all people make mistakes.' All people must learn to admit their errors so that others can forgive them and move forward.
