893 More On 'Benjamin Franklin Was The First President of the USA' .
Humans in America say that the USA has only government. But, when Ben Franklin said that he retired on October 14, 1788 in his autobiography, he said that he terminated his public career. Thus, when Ben terminated, he became a private human. Thus, the USA has two parts.
Chapter II of The Second Treatise of Government by John Locke says that some humans are perfectly free and have no nation. And the other humans have a nation, are not perfectly free, and only have equal human. In 1952, Thomas P. Peardon introduced his review of The Second Treatise of Government by John Locke. (click) On page xvi, Peardon says,
Some uncertainty in Locke's use of the contract arises out of the setting-up of the institutions of Government. Locke was one of the first writers to recognize the distinction between society and government. Now the contract sets up a form of society( civil or political- what we today call the state). Just when and how is government instituted? Pufendoorf had resorted to two contracts to answer this question in his theory. By one, society was instituted by the other , government; and some students argued that two contracts are implied in Locke. Others regard the setting-up of government as the first act of the new community set up by the contract. But this explanation seems to be weak; the mark of a political society is government.
Locke says: Those who are united into one body and have a common established law and jurisdiction to appeal to, with authority to decide controversies between them and punish offenders, are in civil society with one another....
According to this, government is itself an essential part of civil or political society and the two must have come into existence together.
Above, Locke recognized the distinction between society and government. Thus, after Benjamin Franklin became the elected postmaster general of the Continental Congress on July 26, 1775. This action made Ben the first president. Then, on July 4 1767, the Declaration of Independence (DUI) became the 'society', the Constitution became the 'government' and Ben became the first president of the U.S, democracy.
The laws of the Constitution were improved as time passed. However, the DUI was never improved. One reason for the absence of DUI improvements from Senator John D. Rockefeller IV. is that DOI is not considered as law. Locke's said that democracies have a lawful society and lawful government.
I say that the debates today between republicans and democrats are terrible. I also believe that the DUI was not developed by any new laws because money hungry people do not like the saying that 'all Men are created equal.' The Declaration of Independence must become more perfect just as the Constitution is becoming more perfect.
